Standard Terms & Conditions

Effective Date: January 2026

1. The Agreement

These Standard Terms & Conditions, together with your Application and our Critical Information Summary, form the agreement between Peak Net Pty Ltd (ABN 74 689 274 566) and you ("the Customer") for the supply of telecommunications services.

By signing up for or using our services, you acknowledge that you have read, understood, and agree to be bound by these terms.

2. Service Provision

We agree to provide you with the services described in your plan designated at the time of signup. We will use reasonable endeavors to provide the service with due care and skill, but we do not guarantee that the service will be interruption-free or error-free.

Connection speeds may vary due to factors outside our control, including your equipment, line quality, and network congestion.

3. Billing and Payment

  • Billing Cycle: Services are billed monthly in advance.
  • Payment Due Date: Payment is due on the date specified on your invoice.
  • Direct Debit: If you have set up a direct debit, we will debit your nominated account on the due date.
  • Failure to Pay: Failure to pay by the due date may result in a late payment fee, suspension, or disconnection of your service.

4. Cancellations and Refunds

Minimum Term: Most PeakNet residential NBN plans are month-to-month with no lock-in contract, unless otherwise specified in your Critical Information Summary.

Termination Notice: You may cancel your service at any time by providing us with notice. The service will be cancelled at the end of your current billing period.

No Refunds on Pre-payments

Please note that we do not offer refunds on cancellations after payment has been received for the current billing cycle. If you cancel your service mid-month, your service will remain active until the end of your paid billing period, and billing will stop on the next payment cycle. Any unused portion of the month is non-refundable.

5. Fair Use Policy

Your use of our service is subject to our Fair Use Policy. You must not use the service in a way that is unreasonable, excessive, or interferes with other customers' use of the network. We reserve the right to suspend or limit services that breach this policy.

6. Liability

To the extent permitted by Australian Consumer Law, PeakNet is not liable for any indirect or consequential loss (including loss of profits or data) arising from the use of our service. Our liability for any claim is limited to resupplying the service or refunding the fees paid for the affected period.

7. Changes to Terms

We may update these terms from time to time. If a change is likely to be detrimental to you, we will provide you with reasonable notice (usually 30 days) before the change takes effect.
